1. Who we are

Based on Us (basedonus.com) is operated by Clearpoint Systems (“Based on Us”, “we”, “us”). You can reach us any time at support@basedonus.com. By using the site you agree to these Terms, our Privacy Policy and our Refund Policy.

2. What the service is

Based on Us turns your photos and your story into a personalized, AI-generated comic — a digital gift starring the people (and pets) you choose. You upload a few photos, describe the people and the story, pick an occasion and art style, and we generate a comic of 12, 18 or 24 panels. Before paying you see a free sample panel and cover made from your actual photos. After purchase we generate the full comic, which you receive digitally: an online viewer, a private share link for gifting, and a downloadable high-resolution PDF. No physical product is shipped.

3. Eligibility and your account

You must be at least 18 years old to use Based on Us. Purchasing requires signing in with a supported provider (such as Google). You are responsible for activity under your account and for keeping your sign-in method secure.

4. Your content — and what you promise about it

“Your Content” means everything you provide: photos, the names and descriptions of the people in your comic, your story text, and any gift message. By uploading it, you confirm that:

• you own Your Content or have permission to use it;
• every identifiable person in the photos has consented to appear in your comic — and for anyone under 18, a parent or legal guardian has consented. See our Acceptable Use Policy for what content and consent rules apply;
• Your Content does not infringe anyone’s rights and is not unlawful; and
• you will not use the service to impersonate or deceive.

You are responsible for what you put in a gift message and for choosing who receives your comic’s share link.

5. How AI generation works

Comics are generated by artificial-intelligence models from the photos and text you provide. Likenesses are stylized and approximate — the artwork is an artistic interpretation, not a photographic reproduction — and details can vary between generations. Reasonable stylistic variation is inherent to the product and is not a defect. If a panel is genuinely wrong (for example a garbled face), your order’s included edit allotment and our Refund Policy cover you.

6. Licenses

Your Content stays yours. You grant us a worldwide, non-exclusive license to host, reproduce and process Your Content solely to operate the service — including transmitting it to the AI providers that draw your comic (see the Privacy Policy for who they are). We do not use Your Content for advertising or marketing without your separate, explicit consent.

Your comic is for you. To the fullest extent we hold any rights in the generated comic, we grant you a perpetual license to view, download, print, gift and privately share it for personal, non-commercial use. Reselling or commercially exploiting generated comics requires our written permission.

7. Acceptable use

You may not use Based on Us to create or attempt to create:

• any sexual content involving minors;
• sexually explicit imagery;
• content that harasses, threatens, demeans or promotes hatred against anyone;
• non-consensual intimate imagery of any person;
• gore, graphic violence, or content intended to humiliate;
• deceptive depictions of public figures.

You also may not upload photos of people without their permission, probe or abuse our systems, circumvent usage limits, or scrape the service. We use automated screening and may review, block or refuse content that appears to violate these rules, and may cancel violating orders (with a refund where appropriate).

8. Payments

Orders are processed by our merchant of record, Creem. Creem is the seller of record for your purchase: it handles checkout, payment, applicable taxes and invoicing, and its terms also apply to your purchase. Prices are shown in USD before you pay. Discount codes apply only as described when issued and may be single-use.

9. Delivery

Your comic is delivered digitally, normally within minutes of purchase. It is available in your account, via its private share link, and as a PDF download. If you delete your account, your comic is deleted with it and its share link stops working — so download the PDF first if you or the recipient still want a copy.

10. Refunds

Each comic is a personalized, made-to-order digital product. Our Refund Policy explains the free sample, our redraw guarantee, and when refunds are available.

11. Suspension and termination

We may suspend or terminate access for breach of these Terms, unlawful use, or abuse of the service. You may stop using the service at any time and may request deletion of your data as described in the Privacy Policy.

12. Disclaimers

The service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted or error-free, or that generated artwork will meet subjective expectations of likeness or style beyond what the sample shows and the Refund Policy provides.

13. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service is limited to the amount you paid for the order giving rise to the claim, and we are not liable for indirect, incidental or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Governing law

These Terms are governed by the laws of the State of Israel, and disputes are subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Yafo. If you are a consumer in a jurisdiction whose law grants you mandatory protections or a different venue, nothing here limits those rights.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version; material changes will be communicated on the site. Continued use after a change means you accept the updated Terms.
